Welcome to Sail San Fran. By using our website or booking a private sailing charter with us, you agree to the following terms and conditions. Please read them carefully.
1. Booking & Payment
- A deposit or full payment may be required at the time of booking to secure your reservation.
- Prices are subject to change without notice until a booking is confirmed.
- Payment methods include credit card, debit card, or approved third-party processors.
2. Cancellations & Refunds
- Cancellations made more than 7 days before your scheduled sail may be eligible for a full refund.
- Cancellations within 7 days of the scheduled trip may result in a partial refund or credit, at our discretion.
- No-shows or same-day cancellations are non-refundable.
- Trips may be rescheduled in the event of unsafe weather or conditions beyond our control.
3. Weather Policy
Your safety is our top priority. In cases of high winds, heavy fog, or storms, we reserve the right to delay, alter, or cancel a sail. If Sail San Fran cancels due to weather, guests will be offered a full refund or the opportunity to reschedule.
4. Guest Responsibilities
- Guests must arrive on time and follow all safety instructions provided by the captain and crew.
- Children under 12 must wear a life jacket at all times.
- Guests under the influence of drugs or excessive alcohol may be denied boarding.
- You agree to treat the vessel, crew, and other guests with respect and care.
5. Liability Waiver
By booking and boarding The Hawk’s Nest, you acknowledge that sailing involves certain inherent risks. You voluntarily assume all such risks and release Sail San Fran, its owner, crew, and affiliates from liability for personal injury, property damage, or loss, except in cases of gross negligence.
6. Use of Images & Testimonials
By participating in a charter, you grant Sail San Fran permission to use photos or testimonials from your trip for marketing purposes, unless you notify us in writing otherwise.
7. Website Use & Content
All content on this site—including text, images, and branding—is the property of Sail San Fran and may not be copied, reproduced, or distributed without written consent.
8. SMS & Email Communication
By submitting your contact details, you agree to receive emails and text messages related to your booking, inquiries, or occasional promotional offers. You may opt out at any time by following the instructions provided.
9. Governing Law
These terms are governed by the laws of the State of California. Any disputes shall be resolved in the appropriate courts located in Marin County, California.
